Referring to existing scientific studies and practical, mathematical tests, the Fiscal Court of Münster classified poker as a game of skill for the average player. Consequently, this fact-based approach of the fiscal court should also be applied in administrative and criminal law. This would oblige the legislator to „decriminalise“ poker and regulate it in a reasonable and contemporary manner.
